On March 23, 2019, the SSIP Forum of 2019 was successfully held in Beijing. The Forum was co-hosted by the China Intellectual Property Law Association, Renmin University of China Academy of Intellectual Property, and Beijing Sunshine Intellectual Property and Legal Development Foundation (SSIP). The theme of the forum is Intellectual Property Protection and the Reform and Opening-up Policy.
The opening ceremony was presided over by Prof. Yao Huanqing, Secretary-General of the SSIP. Many experts included Zhao Gang, Deputy Director-General of the National Intellectual Property Administration, Wang Chuang, Deputy Secretary and Vice President of the the Intellectual Property Tribunal of the Supreme People's Court, and Professor Liu Chuntian, President of China Intellectual Property Law Association delivered speeches on the opening ceremony. Zhao Gang pointed out that with the great practice of reform and opening-up, China's intellectual property system continues to develop and improve. This provides a good foundation to expand the reform and opening up policy and to strengthen intellectual property protection. Professor Liu Chuntian indicated that the intellectual property is a cause under the sunshine, and it is indispensable to the high-quality development of the new economy featured by the Internet industry.
This forum is divided into three forums: the Main Forum and two sub-forums. The theme of the Main Forum is "Reform and Opening-up and the Rule of Law of Intellectual Property in China". The two themes of the sub-forums are "Internet Innovation and Intellectual Property Protection" and "Intellectual Property Judicial Protection and Mechanism Innovation".
The Main Forum was moderated by Prof. Guo He, Associate Dean of the Academy of IP, Renmin University of China. In the forum, experts and professionals from the industry focused on the the following topics, such as (1) “The Improvement of Patent’s Quality,” (2) “The In-depth Reform of Trademark System to Promote High-quality Economic Development,” (3) “Reform and Opening-up and the Development and Improvement of China's Intellectual Property Judicial System” and (4) “Intellectual Property Rights in China's Import and Export Trade.” Experts and professionals shared their views on the above-mentioned issues.
Sub Forum 1:
The sub-forum on The Innovation of Judicial Mechanism and Judicial Protection of IP was moderated by Prof. Li Yufeng, Vice-President of the China Intellectual Property Law Association. Experts and professional from the industry exchanged their view on the following subjects: (1) Shanghai’s exploration and practice in strengthening IP judicial protection, and reform of the judicial mechanism; (2) Guangdong’s practice on using new evidentiary rules to solve the problems in deciding the amount of compensation, and applying evidentiary rules to solve the problem of being difficult to provide proof of damage; (3) Beijing IP court’s practice on the reform of trial procedure; and (4) Guangzhou IP court’s practice and exploration in strengthening the protection of IP.
Sub Forum 2:
The sub-forum on Internet Innovation and Intellectual Property Protection was chaired by Prof. Li Mingde, E*ecut*ve Vice-president of the China Intellectual Property Law Association and Huang Haifeng, attorney of Jones Day. Experts and professionals from the industry exchange ideas on the following topics: (1) how to reform the Internet IP judicial protection system to ensure that IPers have faith in the system; (2) the convergence of the trial practice and technology and its effects on IP trials; (3) six keywords in Ad-blocking cases; (4) IP trials in the new era of Internet; (5) Textbooks and IP protection; (6) the duty of attention in Internet copyright infringement; and (7) judicial protection for video games.
The IP system is actually a result of the policy of reform and opening-up. It is established and improved along with the progress of the policy. And the development of the IP system in turn will promote the development of the reform and opening-up policy. The forum summarized the experience of intellectual property protection in China in the past 40 years of reform and opening-up and discussed the protection of intellectual property rights under the new situation. It is believed that this forum helps to enable the IP system to play its role in encouraging innovation and promoting the open policy. The forum is also beneficial to the improvement of IP system and the level of protection. It is believed that the forum is beneficial to the high-quality development of China’s economy.
