On October 4, 2012, the international symposium on "New Development of China’s Intellectual Property (IP) Law" was held in Berkeley, California, United States. The symposium was jointly organized by Renmin University of China, School of Law and Academy of Intellectual Property, the UNESCO Chair of Copyright and Neighborhood Rights, the Law and Technology Center of the UC Berkeley, and Loyola University, School of Law. More than 100 representatives, including scholars, professionals and entrepreneurs from both China and the United States participated in the symposium.
At the opening ceremony, Professor Liu Chuntian, who is the president of China Intellectual Property Law Association and Dean of Academy of IP, Renmin University of China, Professor Jennifer Roseman of Loyola Law School and Professor Robert Merges of Berkeley Law and Technology Center delivered speeches on behalf of the organizers, introducing the purpose and significance of the symposium, and extending a warm welcome and gratitude to all the participants.
The symposium was divided into the following five parts: (1) Amendment of China’s copyright law; (2) Views and expectations from abroad on the amendment of China’s copyright law; (3) Trends of IP law enforcement in China; (4) Disputes on IP law enforcement in the entertainment industry; and (5) Disputes on IP law enforcement in the technical field.
Professor Liu Chuntian, Professor Li Chen, Professor Guo He and Associate Professor Zhang Guangliang from Academy of IP, Renmin University of China gave speeches on relevant topics. Professor Liu Chuntian introduced in detail the legislative history of China’s copyright law and the major issues in its fourth amendment. He also emphasized that the legislative process of the fourth revision is open to all the public, and welcomes advice and criticism from all sectors of the society. By analyzing a number of specific issues in copyright law, Professor Li Chen emphasized that China’s copyright rules and regulations should be streamlined and systemized to reduce conflicts in the law. Professor Guo He summarized and introduced the rules and regulations, law enforcement mechanisms and problems in the enforcement of IP rights in China's entertainment industry. And Associate Professor Zhang Guangliang introduced the remedies in China’s patent law by analyzing the disputes between Apple and Samsung.
Professor Robert Merges from Berkeley Law and Technology Center and other foreign experts also made speeches on China’s copyright legislation and enforcement.
The symposium successfully achieved its goals. It covered a number of important issues on China’s copyright legislation and the overall system of IP enforcement in China. Through communication, we have introduced the latest developments of China’s IP legislation and enforcement practice to the American academic community, and also understood the views, legislations and practice of the United States on related issues. Therefore, this symposium provides information and resources for the fourth revision of China’s copyright law and the improvement of China’s IP law enforcement mechanism.
