SSIP Co-hosts the Forum for the Revision of Intell

On December 8, the Forum for the Revision of Intellectual Property Laws: Annual Conference of China Intellectual Property (IP) Law Association for the Year of 2012 was held in Suzhou High-tech Zone. The opening ceremony was hosted by Professor Liu Chuntian, President of the China Intellectual Property Law Association (hereafter “the Association”) and Dean of the Intellectual Property Academy, Renmin University of China. More than 340 participants attended the conference, including officials from IP-related legislative, judicial and administrative offices, professionals from private sectors or law firms as well as scholars and researchers from research institutes and universities.
Yan Xiaohong, Deputy Director of the State Press and Publication Administration, delivered a speech at the opening ceremony. He pointed out that this conference was of great practical significance. The report of the 18th National Congress of the CPC set out the strategy of innovation-driven development, which is closely related to IP policies. IP laws are the new driving force for innovation-driven development. Therefore, we should improve the system for knowledge society and innovation, implement the national IP strategy and strengthen the protection of IP rights. He said that the third revision of the copyright law was almost finished and that many experts and scholars at the conference had directly or indirectly participated in revising the copyright law. Thus, he would like to express his gratitude to all the contributors to the new revision of the law. Finally, he hoped that experts and scholars could pay more attention to the practical issues, such as copyright protection for folklores, and provide more theoretical support for relevant legislation.
After Yan’s speech, Professor Li Mingde, Director of the Institute of Law for the Chinese Academy of Social Sciences and E*ecut*ve Vice-President of the Association, read a congratulatory letter from the China Law Society to the conference. In the letter, China Law Society spoke highly of the remarkable achievements made by China IP Association since its establishment in May this year, and expressed its hope that China IP Association could do even better in the future.
Pu Ronggao, Vice Mayor of the People’s Government of Suzhou, also delivered a speech at the opening ceremony. On behalf of the People’s Government of Suzhou, he warmly welcomed the leaders, experts and scholars who participated in the annual conference, and introduced in detail how Suzhou implement the IP strategy and its achievement in recent years.
Kong Xiangjun, Chief Justice of the IP Tribunal of the Supreme People’s Court, reported on the topic of “Judicial Protection for IP.” He pointed out that the Supreme People’s Court had made great efforts in protecting IP rights fairly, transparently and consistently. It had set unitary legal and policy standard for judicial protection for IP throughout China, so as to strengthen the protection of IP rights. Justice Kong further talked about topics such as the “localization and globalization of IP judicial protection” and “the strength and framework of judicial protection for IP.”
Zhang Jianhua, Director of the Department of Education, Culture and Health of the Legal Office of the State Council, made a keynote speech on the topic of “the Revision of Trademark Law.” In his opinion, in the revision of the trademark law, there are three problems that need to be paid special attention to: the cumbersome procedures of trademark registration, trademark-squatting, and the maintenance of the structure of the existing trademark law.
Wang Ziqiang, Director of the Regulations Department of the State Copyright Administration, gave a talk on “What, Why and How to Revise the Copyright Law.” Finally, Song Jianhua, Director of the Treaties and Laws Department of the State Intellectual Property Office, made a detail report regarding the revision of patent law. He covered topics such as the difficulty for right holders to provide evidence on patent infringement and the prolonged patent litigation procedure, which makes the protection for patent rights ineffective and inefficient.
China Intellectual Property Law Association is a non-governmental organization consisting of scholars and professionals who are committed to do research in the area of intellectual property law. It currently has nearly 500 members. Since its establishment in May this year, the Association has arranged its members to do research in a number of practical issues in IP law, provided advice to the legislative offices, enhanced the connection with academic circles abroad, and made great contribution to the development of China’s IP law.
At this annual conference, the Association actively implement the spirit of the 18th National Congress of the CPC, and strives to solve IP-related problems with a pragmatic attitude and innovative spirits, and actively explores countermeasures to the problems. For example, the Association and Suzhou City have co-established a research center in the Yangtze River Delta. This is a new model for IP research organization to render service for the local development of the innovation-driven strategy. In addition, a two-day conference was held to discuss topics regarding the revision of trademark law and patent law. These topics include “Administrative Enforcement of IP Rights,” “Compensation and Damage for IP Infringement,” “Issues related to the ‘Regulations on Inventions for Hire’ (Draft)”, “Circular Litigation Problems in Patent and Trademark Cases,” “Trial and Mediation of IP Cases: from the Judges’ Perspective”, “Free Talk on the Revision of Patent Law,” “The Qualification of Trademark Right Holders and the Rules for Trademark Infringement,” “International Trends of IP Legislation,” “Free Talk on the Revision of Copyright Law,” and “Legal Protection for Patent Right.”
