On July 20, 2016, seminar on “the Latest Development of China-US Copyright Law” was successfully held in Conference Room 601 of Renmin University of China School of Law. The seminar was co-hosted by China Intellectual Property Law Association, Renmin University of China School of Law and Academy of IP, and the USPTO. Nearly one hundred experts from China and the United States attended the meeting to discuss the history, background, main content and latest developments of the copyright laws of China and the U.S. in depth. Participants of this seminar came from government, court, academics and industry, including officials from the National Copyright Administration and former staff of Legislative Affairs Office of the State Council, judges from Beijing Intellectual Property Court, officials and scholars from the USPTO, the U.S. Embassy in China, University of Oregon School of Law, famous scholars from Renmin University of China, China University of Political Science and Law, Tsinghua University, Chinese Academy of Social Sciences Institute of Law, University of Chinese Academy of Sciences, Beihang University, Beijing Foreign Studies University, Shandong University, Minzu University of China, Hebei University and other famous universities and research institute, industry representatives and lawyers from Music Copyright Society of China, China Written Works Copyright Society, International Publishers Copyright Protection Alliance in China, International Confederation of Societies of Authors and Composers (CISAC), United States Information Technology Office in Beijing, NBA, Software Alliances, Microsoft, and Outdustry, etc. This seminar has enhanced mutual understanding between China and the United States in the field of copyright and promoted exchanges between industry and academics, the judiciary and the administrative agencies. At the same time, it also provides a solid theoretical foundation and communication platform for promoting the common progress of China and the United States in copyright legislation, judicial and administrative protection and cooperative communication in related fields.
Professor Liu Chuntian, Dean of Academy of IP, RUC and President of the China Intellectual Property Law Association, and Mark Cohen, Senior Advisor to the USPTO, delivered opening speeches on behalf of China and the United States respectively. The opening ceremony was moderated by Joel Blank, Intellectual Property Commissioner from the U.S. Embassy in China. Professor Liu Chuntian expressed his welcome and gratitude to the experts present, while Mark Cohen pointed out in his speech that the exchange can promote cooperation and wish the seminar a complete success.
On the morning of July 20th, the participants of the seminar discussed the following three themes, “The Development of China-US Copyright Law from the Perspective of Academia,” “The Trademark and Revenue Diversity of the Content Industry: all things tend in one direction,” “U.S. Copyright Law and Policy: History and Latest Development.”
The first section was moderated by Joel Blank, Intellectual Property Commissioner of the US Embassy in China. Eric Priest, Associate Professor of the University of Oregon School of Law, gave a report on the theme “The Development of China-US Copyright Law from the Perspective of Academia.” Mark Cohen, Senior Advisor to the USPTO, gave a report on the topic “The Trademark and Revenue Diversity of the Content Industry: all things tend in one direction.” Cong Lixian, Professor of Beijing Foreign Studies University Law School, Li Yuxiang, Professor of Civil, Commercial and Economic Law School of CUPSL, Liu Xiaohai, Professor of Tongji University Law School, and Yun Xuan, Deputy Director of NBA China Law Department, respectively commented on these reports. Zhang Yongfan, Professor RUC Law School, expressed his views on the understanding of copyright in Chinese history.
The second section of the seminar is about “American Copyright Law and Policy: History and Latest Development,” and it was also moderated by Joel Blank. Neil Graham, Counselor of the USPTO Policy and International Affairs Department, delivered a brilliant speech. Sun Guorui, Professor of Beihang University, Wu Weiguang, Associate Professor of Tsinghua University Law School, Xiong Wencong, Associate Professor of Minzu University of China, and Peng Zhe, Associate Professor of Shandong University Law School, respectively commented on the foregoing talks.
On the afternoon of July 20th, the two topics, i.e. “Background, Main Contents and Progress of China’s Copyright Law Revision” and “Development of China’s Judicial and Administrative Protection for Copyright,” will be discussed. Keynote speeches will be delivered by Deputy Chief Director Duan Yuping and Director Xu Wei from National Copyright Administration, and Zhang Xiaojin, judge from Beijing Intellectual Property Court. All of the participants will discuss these two topics in depth.
