On the afternoon of April 22, 2014, "China-us Trade Secret Protection Roundtable Meeting,” co-hosted by Renmin University of China, School of Law and Academy of Intellectual Property (IP), China Intellectual Property Law Association and organized by Beijing Sunshine Intellectual Property and Legal Development Foundation (“SSIP”), was successfully held in the International Lecture Hall 601, Mingde Law Building, Renmin University of China. More than 40 Chinese and American judges, experts and scholars attended the roundtable meeting, including those from the United States Court of Appeal for the Federal Circuit, USPTO, the US Embassy, the US-China Business Council, USITO, Microsoft, IBM, Intel (China) co., LTD., (China) co., LTD., Siemens (China) co., LTD., WilmerHale, the Supreme People’s Procuratorate, the Supreme People’s Court, the State Administration for Industry and Commerce, National Office for the Fight against Infringement and Counterfeiting, Beijing Higher People’s Court, Beijing First Intermediate People’s Court, Beijing Second Intermediate People's Court, Taiwan Intellectual Property Court, Renmin University of China, Tsinghua University, China University of Political Science and Law, East China University of Political Science and Law, Beijing Institute of Technology, Zhongguancun Intellectual Property Strategic Research Institute, Chinese Academy of Sciences, Beijing JT&T law firm, Beijing Lawjay Partners, Beijing Panawell & Partners, etc.
Professor Liu Chuntian, President of the China Intellectual Property Law Association and Dean of the Academy of IP, RUC and Prof. Mark Cohen, Senior Advisor of the USPTO and Adjunct Professor of RUC, delivered speeches on behalf of China and the United States respectively and gave a brief introduction on the background, significance, and the form of discussion for the roundtable meeting before the meeting officially began.
The first topic “Trade Secret Protection Strategy and Legislative Framework” was co-chaired by Mr. Joel Blank, the IP Commissioner of the US Embassy in China, and Mr. Tan Jian, the National Office for the Fighting of Infringement and Counterfeiting. Experts discussed topics such as the risks of disclosure while companies were fulfiling their obligation to submit their trade secrets for administrative approval, business strategies for the protection of trade secrets, the progress of trade secret legislation in China, etc. Experts had a in-depth discussion based on experience and practice from Mainland China, Taiwan Province of China and the United States.
The second topic “Development in the Enforcement of Trade Secrets Law” was co-chaired by Judge Randall Rader, Chief Judge of the Federal Circuit and Guest Professor of RUC and Member of the Academic Committee of Academy of IP RUC, and Director Wan Chun of the Investigation and Supervision Office of the Supreme People’s Procuratorate. The participants exchanged views on the topics such as the role of civil law enforcement in the protection of trade secrets, the challenges faced by civil courts, the remedy of injunctions, and the latest development of the enforcement of trade secret law, etc.
At the end of the meeting, Professor Liu Chuntian and Professor Mark Cohen, on behalf of China and the United States respectively, made concluding speeches. Experts from the two sides both agreed that trade secrets are very important to the development of China and the United States. It is necessary and rewarding to hold such round tables and have such candid communication. At the same time, the two sides expressed their desire to continue in-depth cooperation in the next step.
