On January 7, 2015, “Seminar on the New Development of Globalization and Intellectual Property” co-hosted by China Intellectual Property Law Association and Beijing Sunshine Intellectual Property and Legal Development (SSIP) was held in Beijing. More than 40 IP experts from home and abroad attended the seminar to discuss the new development of globalization and intellectual property.
Professor Liu Chuntian, Dean of the Academy of IP, Renmin University of China and President of the China Intellectual Property Law Association, acted as a moderator for the seminar. Mr. Yan Xiaohong, Deputy Director of the National Copyright Administration of China, Max Baucus, US Ambassador to China, and Ellen Szymanski, Director of the Global IP Center for the American Chamber of Commerce attended the seminar and delivered speeches.
Mr. Yan Xiaohong pointed out that China’s IP industry has entered a new stage of development that companies know how to use, protect and manage their IPs. In 2012, copy-related industry has accounted for 6.87% of the national GDP, making an important contribution to the steady growth of China’s national economy. China’s economic development no longer relies on the extensive exploitation of resources, but has entered into a new era of innovation-driven development. In the new economic situation, we need to improve our IP system, to make it an IP system that both has Chinese characteristics and meets the international standards. It is not only necessary but also important to enhance IP protection. There is an urgent need to improve China’s IP management and the public awareness of IP.
Ambassador Max Baucus pointed out that IP is an essential element for economic progress and that the IP is a system that recognizes and rewards the spirit of human creativity and innovation. Through cooperation and mutual learning between Chinese and American companies, academic institutions, and governments, we can find good ways to overcome the limitations from at home and abroad faced by innovators.
A short film entitled “Creativity and Innovation: The Watershed of China’s Transformation and Development,” produced by the American Chamber of Commerce to introduce the development of IP system in China, was shown at the seminar. Director Ellen Szymanski introduced the background, theme and significance of the short film and expressed her gratitude to the audience who saw this film. She pointed out that China is at a turning point in development, and coordination and cooperation are crucial to future innovation. China's intellectual property policy not only affects the operations of foreign companies in China, but also affects the ability and success of domestic companies to participate in international competition.
The experts discussed in-depth on the short film and topics such as “International Coordination and Cooperation of IP in the Internet Age”. IP experts and practitioners, such as Song Yushui, Zheng Shengli, Qu Sanqiang, Qiu Anman, Zhang Ping, Zhou Lin, Feng Xiaoqing, Cui Guobin, Ma Xiaogang, Wang Haibo, Yang Xuri, David Kabos, Randall Rader, Mark Cohen, Eric Priest, etc. gave wonderful talks on the topic. Professor Liu Chuntian gave a concluding speech. He pointed out that the short film objectively and rationally reflects the development of China’s IP cause and put forward new problems, challenges and expectations. The Chinese IP community should not only thank the American colleagues for their encouragement, but also rationally recognize that China is still a developing country, and the development of China and the United States is still not at the same stage. China’s IP system and market economy are still in the elementary state and still have many difficulties and problems. We must continue to move forward with our achievements and confidence in the new year.
Many experts attended this seminar, including Zhang Junqin, official of the WIPO China Office, Yin Xintian, former Director of the Department of Treaties ans Laws of State Intellectual Property Office, Cheng Yongshun, director of the Beijing Intellectual Property Institute and former Vice Chief Judge of the Intellectual Property Tribunal of Beijing Higher People's Court, Professor Ma Yide, Director of Zhongguancun Intellectual Property Strategic Research Institute, Li Chen, Professor of Renmin University of China School of Law and Academy of IP, David Kappos, former Commissioner of USPTO, Randall Rader, former Chief Judge of the Federal Circuit, Mark Cohen, Senior Advisor to the USPTO, Tony Chen, Partner of Jones Day, Eric Priest, Professor of University of Oregon, and experts from Beijing People’s Procuratorate , Peking University, Tsinghua University, Renmin University of China, Beijing Institute of Technology, China University of Political Science and Law, Chinese Academy of Sciences, Chinese Academy of Social Sciences, Beijing University of Chemical Technology, Zhongguancun Intellectual Property Strategic Research Institute, Beijing Power-Nation Institute and the Ministry of Industry and Information Technology, etc., and experts from technological firms, CCTV, Legal Daily, Intellectual Property Daily, and Intellectual Property Magazine, etc. This seminar provided a platform of IP specialists to discuss the new development of globalization and intellectual property and contribute their wisdom to the improvement of China’s reform policy and IP system.
In the afternoon, Judge Randall Rader, accompanied by two Professors, Cheng Yongshun and Ma Yide, led a delegation of Amercian experts to visit the Beijing Intellectual Property Court. Vice Chief Judge Chen Jinchuan introduced the guiding principle for the work of the court, jurisdiction, judges, and reform measures of the court. The US experts showed great interest in the establishment of IP courts in China and expressed appreciation for the efficient work of the Beijing Intellectual Property Court at its starting stage. They also introduced the experience of the U.S. Court of Appeals for the Federal Circuit and the practice of the “Technical Investigation Officer” and “Friends of the Court”. Experts from the two sides expressed their hope to further deepen exchanges and cooperation between them.
