On July 21, 2016, seminar on “Trademark/Brand and Economic Growth: Contribution of Intellectual Property to Economic Growth” co-hosted by UK Intellectual Property Office (UKIPO), the British Embassy in Beijing, and Renmin University of China Academy of Intellectual Property, co-organized by UK Prosperity Funds and Beijing Sunshine Intellectual Property and Legal Development Foundation (SSIP), was held in Beijing.
More than 80 participants attended the meeting, including officials and judges from UKIPO, the British Embassy in Beijing, the State Administration for Industry and Commerce of PRC (SAIC), the State Intellectual Property Office (SIPO), Beijing Higher People’s Court, and Chongqing Intellectual Property Office, etc., and professors and experts from Renmin University of China, Tsinghua University, China University of Political Science and Law, Southwest University of Political Science and Law, Zhongnan University of Economics and Law, Nankai University, Beihang University, Tongji University, University of International Business and Economics, Beijing University of Chemical Technology, Zhejiang Gongshang University, Northwest University of Politics and Law, Zhongguancun Intellectual Property Strategy Research Institute, and Chinese Academy of Sciences, etc., and consultants and directors from leading companies, such as Alibaba, Lenovo, Cofco, Schneider Electric, AkzoNobel, ELM, etc, as well as lawyers and experts from the China-Britain Business Council (CBBC), Business Software Alliance (BSA), China Trademark Association, China Intellectual Property Society (CIPS), Beijing Intellectual Property Protection Association, Global Law Office, East&Concord Partners, Longan Law Firm, Juncun Law Office, China Technology Exchange, Beijing East IP Ltd. and Beijing East IP Law Firm, Wanhuida Peksung, Rouse, Kangxin Partners, P.C, NTD Law Office, Advance China IP Law Office, HHJC Intellectual Property & Partners, Trendsun Partners, F&S Intellectual Property Ltd. , etc. Besides, media support was provided by People's Daily Online, Zhichanli, China’s Economic Daily, China Intellectual Property News, Intellectual Property, China Trademark, etc.
The seminar lasted for one day and consisted of three parts: the opening ceremony, the keynote speech and the panel discussion. At the opening ceremony in the morning, Professor Liu Chuntian, Dean of Academy of IP RUC and President of the China Intellectual Property Law Association, and Mr. Tom Duke, senior Intellectual property Liaison Officer of the British Embassy in Beijing, respectively made remarks on behalf of China and the UK. Professor Liu Chuntian first expressed his welcome and gratitude to the participants, and shared his personal philosophical thinking on the intellectual property system. He believed that it is of special significance to organize meetings in cooperation with the UK, which is the hometown of modern intellectual property law. Mr. Tom Duke introduced the working functions of the UK-IPO and the background, origin and related research on the value of the China-UK cooperation.
After the opening ceremony, the seminar entered into the keynote speech stage. Ms. Philippa Hall, Chief Economist of the UK-IPO, introduced to the participants the main functions, research findings and research methods of the economist team of the UK-IPO. Subsequently, there was a free discussion and Q&A session moderated by Professor Yao Huanqing, professor of Academy of IP RUC. Mr. Tom Duke and Ms. Philippa Hall made detailed explanations and gave responses to the questions of highest concern, such as how to use economic methodology in changing the IP system and policy making, how to coordinate the economists team, how to tackle the problem of trademark-squatting, and how to evaluate the value of IPs.
The seminar in the afternoon mainly focused on topics such as “The relationship between brand/trademark strength and economic growth,” “How to make use of brands in the technological innovation system" and “‘Internet +’’s challenges to the Legal System of Trademarks".
In first section regarding "The relationship between brand/trademark strength and economic growth,” Mr. Dong Baolin, former Deputy Inspector of the Trademark Office of SAIC, Ms. Philippa Hall, Chief Economist of the UKIPO, and Yao Huanqing, Professor of Academy of IP RUC respectively gave a speech from the perspectives of trademark and the growth of firms, trademark and national economic growth, trademark and international trade, and the relationship between trademark and innovation economy. Subsequently, Professor Li Yufeng from the Southwest University of Political Science and Law made a remark on the speeches of three speakers.
In the second section regarding "How to make use of brands in the technological innovation system,” Mr. Wang Cong, Director of China Quality Manufacturing Operations of Alibaba Taobao, Ms. Zhang Qiong, Senior Lawyer of Lenovo Legal Department, and Mr. Lu Peng, director of Intellectual Property of Schneider Electric Greater China, respectively gave a speech entitled “How to Get Out of the Infringement Dilemma through Brand Empowerment,” “Brand Commercialization under the Technological Innovation System,” and "Brand Building under the Technological Innovation Environment.” Subsequently, Professor Ma Yide, director of the Zhongguancun Intellectual Property Strategy Research Institute, commented on the speeches of the three speakers.
In the last topic “‘Internet +’’s challenges to the Legal System of Trademarks", Zhong Ming, judge from the Intellectual Property Tribunal of the Beijing Higher People’s Court, Guo Hai, Associate Professor from the Business School of RUC, and Gui Jia, partner of the Global Law Office, made reports entitled “New Trends of Infringement of Trademark Rights on the Internet.” “Savage Growth of China’s Internet Economy: Reflections from Institutional Perspectives,” and "New Changes in Trademark Disputes in the New Internet Era.” After that, Professor Li Chen from Academy of IP RUC made comments on the speeches of the three speakers.
The one-day seminar not only deepens our understanding of the relationship between trademark/brand and economic growth, but also broaden our understanding of IP policy from the dimension of the methodology of police-making. The seminar is highly welcomed by the IP community.
It is reported that this seminar is another good example of cooperation between China and Britain following the cooperation in hosting the “Forum on Legislation and Practice of Chinese and British Copyright Collective Management Organization” in September last year. On the basis of the previous cooperation, the two sides will focus on the theme of “Trademark/Brand and Economic Growth” in this year to carry out a series of content-rich activities such as large-scale forums, keynote reports and discussions on specific issues, and continue to push forward the in-depth cooperation between the two sides, so as to open up new room, enrich new content and accumulate new consensus for cooperation and exchanges between China and Britain in the field of intellectual property.
