“The China-UK Trademark Summit” was held in Beijin

On August 25th, 2016, “The China-UK Trademark Summit” co-hosted by the UK Intellectual Property Office (UKIPO), the British Embassy in Beijing, Renmin University of China Academy of Intellectual Property and co-organized by the UK Prosperity Fund and Beijing Sunshine Intellectual Property and Legal Development Foundation (SSIP), was held in Beijing.

More than 230 participants attended the Summit, including officials from the UK Department for Business, Energy & Industrial Strategy, the UKIPO, the British Embassy in Beijing, the State Administration for Industry and Commerce of the People’s Republic of China (SAIC), the China State Intellectual Property Office (SIPO), and Chongqing Intellectual Property Office, etc, IP judges from the UK Intellectual Property Enterprise Court, the Supreme People’s Court of PRC, the Beijing Intellectual Property Court, etc, IP professors from Oxford University, King’s College London, Tsinghua University, Renmin University of China, Southwest University of Political Science and Law, directors from China-UK associations and research institutions, such as the UK high-end luxury brands alliance, Chartered Institute of Trade Mark Attorneys, Anti Copying in Design (ACID), China Trademark Association, Zhongguancun Intellectual Property Strategy Research Institute, Beijing Justra Intellectual Property Center, Beijing Intellectual Property Institute, China-Britain Business Council, etc., in-house counsels from Chinese and British companies, such as Alibaba, JD, LeTV and Burberry, and representatives from the European Union, the United States, Singapore, Canada and other countries and regions.

The forum lasts for one day and consists of four parts: opening ceremony, project reports, panel discussion and closing ceremony. The opening ceremony was presided over by Prof. Liu Chuntian, Dean of Academy of IP RUC. Wang Liming, E*ecut*ve Vice President of Renmin University of China, Liu Junchen, Deputy Head of the SAIC, and Baroness Neville-Rolfe, Minister of State for Energy and Intellectual Property, delivered speeches in the opening ceremony. Wang Liming, Vice President of RUC, introduced the important position and outstanding contribution of Renmin University of China in intellectual property education and academic fields to the Chinese and foreign audience. Liu Junchen, Deputy Head of SAIC introduced the current situation of the development of China’s trademark/brand industry and the latest initiatives of the Chinese government in promoting trademark/brand protection, construction and development. Baroness Ruffy fully affirmed the role of the trademark system in promoting the brand economy, and gave high praise to the development of China’s brands and designs.

After the opening ceremony, Professor Yao Huanqing from Academy of IP RUC presented the latest progress of the China-UK intellectual property cooperation project. Professor Yao Huanqing first reported on the work carried out by the SSIP in recent years, and then introduced the China-UK Trademark/Brand and Economic Growth Research Project and the main issues, objectives and achievements of its research.

The first section of the discussion, “Judicial Protection of Trademarks,” is divided into two parts, i.e. speeches and comments. It is moderated by Professor Ma Yide, Director of Zhongguancun Intellectual Property Strategy Research Institute. Richard Hacon, Chief Justice/President of the UK Intellectual Property Enterprise Court, Chen Jinchuan, Vice Chief Judge of Beijing Intellectual Property Court, Jin Kesheng, former Vice Chief Judge of the Intellectual Property Tribunal of the Supreme People’s Court and Liu Kongzhong, Professor of Academy of IP RUC respectively delivered speeches on the topic of the “Trademark Protection Practices in the UK and the EU,” “New Issues and Strategies for Trademark Judicial Protection under the New Trademark Law,” “China's Trademark Judicial Protection and Innovation System Construction” and “Trademark Judicial Protection from a Comparative Perspective.” Cheng Yongshun, Director of Beijing Intellectual Property Institute commented on the speeches of the four speakers. The second part was the discussion and interaction between the speakers and the audience. All of the speakers and participants had a positive and open discussion on the issue of trademark protection.

On the second section was moderated by Li Yufeng, the Deputy Director of the Chongqing Intellectual Property Office and Professor of Southwest University of Political Science and Law. The issue of “International Trademark System and International Brand Protection” was discussed in this section. Mr. Geoffrey YU, former Deputy Director General of the WIPO,  Frederick Mostert, representative of the UK High-end Luxury Brands Alliance and Professor of Oxford University, Mrs. Catherine Wolfe, representative of the Chartered Institute of Trade Mark Attorneys, made speeches entitled “Protection of Brands in International Trademark System,” “New Development of Trademark Protection in China and the UK” and “Current Situation of the Development of Trademark Agency Industry in the UK.” Cao Zhongqiang, Director of Beijing Justra Intellectual Property Center, commented on the speeches of the three speakers. After that, the speakers and the participants had further discussion on the foregoing issues.

The third section, “Brand Promotion and Commercialization of Intellectual Property Rights,” was moderated by Willa Huang, Director of China Policy Department of the UK-IPO. Fu Yongjun, researcher of the Trademark Office of National Intellectual Property Administration, Mrs. Dids MacDonald, CEO of the Anti Copying in Design (ACID), and Mr. Jin Gaoping, Senior Specialist of Legal Affairs Department of Alibaba gave speeches entitled “Trademark Pledge Financing - Using the Value of Trademark Assets to Broaden Financing Channels,” “The Role of Design in Branding and Commercialization of Intellectual Property - from British Perspective,” and “International Strategy for Corporate Brands and International Protection of Trademarks.” Dr. Wang Ze, Deputy Secretary-general of the China Trademark Association, made a remark on the speeches of the three speakers.

At the closing ceremony, Director Huang Weijie and Deputy Secretary-General Wang Ze respectively made concluding remarks on behalf of the Chinese and British organizers. Both sides expressed their congratulations on the success of this forum, their gratitude to all the participants, and their appreciation for the professional, responsible, pragmatic and open attitude shown in this forum.

The Summit is the latest achievement of the series of activities on the theme of “Trademark/Brand and Economic Growth” between China and the UK, which has attracted wide attention from the Chinese and British government, the judiciary, academia, industry and the legal profession. The convening of the forum will inject positive energy from the intellectual property community to deepen the long-term, open and win-win "Golden Age" of China-UK relations, and provide strong support for China-UK construction of a comprehensive global strategic partnership for the 21st century.
