The "China Intellectual Property Judicial Protection Outline (2016-2020)" (hereinafter referred to as "Outline") set the goals to explore the nature of IP adjudication and construct an IP protection system based on civil adjudication, supplemented by administrative and criminal adjudication. Over the years, the courts have continued to make efforts to explore the establishment of judicial institutions and procedural ruls that meet the needs of IP protection and the fair resolution of IP disputes, such as to establish specialized IP courts, to implement three-in-one IP civil, administrative and criminal trials, to train professional trial teams, and to explore litigation system, trial procedures and evidentiary rule specific to IP litigation, etc. The quality and efficacy of IP adjudication has been improved dramatically and remarkable progress has been achieved. The courts have accumulated rich experience for the development of special procedures for IP adjudication. At present, the conditions for making special procedural rules for IP adjudication are basically mature. Therefore, the Outline puts forward the task of "promoting the enactment of special procedural rules that are in line with the characteristic of IP adjudication," making special procedural rules regarding jurisdiction, evidentiary rules and the courts' authority in reviewing the validity of patent and registered trademark, etc. To this end, the China IP Practice Forum 2019 will be held in Nanjing on July 20, and the theme of the Forum will be "Important Issues regarding Special Procedures in IP Litigations."
