The First China Intellectual Fortune Forum & Convention for the Establishment of IP Protection Alliance for Listed Companies was successfully held in Shenzhen
On December 8th, the “First China Intellectual Fortune Forum & the Convention for the Establishment of IP Protection Alliance for Listed Companies” hosted by China Law Society Intellectual Property Law Association was successfully held in Shenzhen. The Forum was under the supervision of Shenzhen Market Supervision Administration (Shenzhen IP Office) and supported by Shenzhen Stock Exchange, Shenzhen Nanshan District People’s Government, and Beijing Sunshine Intellectual Property and Law Foundation.
In February this year, the Central Committee of the Communist Party of China and the State Council issued the “Outline of Development Planning for the Guangdong-Hong Kong-Macao Greater Bay Area”. In August, the “Opinions of the Central Committee of the Communist Party of China and the State Council on Supporting Shenzhen to Build a Pilot Area for Socialism with Chinese Characteristics” was issued. The Forum took this as an opportunity, invited more than 300 experts and scholars, including those from the Supreme People’s Court, Supreme People’s Procuratorate, National Copyright Office, National IP Administration, China Intellectual Property Association, China Trademark Association, China Industry Newspaper, Shanghai IP Office, Shenzhen Market Supervision Administration (Shenzhen IP Office), Shenzhen Stock Exchange, Shenzhen Nanshan District People’s Government, WIPO China Office, Beijing Haidian District IP Office, International Trademark Association, Zhongguancun Intellectual Property Strategy Research Institute, Jiangsu Higher People’s Court, Jiangxi Higher People’s Court, Appotronics Corporation Ltd., China Resources (Holdings) Co., Ltd, TCL Group, Poly Culture Group Corporation Limited, Xiaomi Technology, Jinlong Machinery & Electronics Co., Ltd., Shenzhen Qianhai Belt and Road Legal Service Federation, China (South) Intellectual Property Operation Center, Perplevine IP, Hartend, Zhongzhuan Longtian IP Operation (Shenzhen) Co. Ltd., Jones Day Associate, Longnuo Law Firm, Beijing DeHeng Law Office, Intel (China) and Renmin University of China, Xiamen University, Wuhan University, Southwest University of Political Science and Law, Shenzhen University, Shantou University, to discuss on frontier issues and thorny problems on “Intellectual Property, Technological Innovation and Capital Market”, to actively support the construction of the greater bay area of Guangdong-Hong Kong-Macao, and the Pilot Area of Socialism of Chinese Characteristics.
On November 24, the General Office of the CPC Central Committee and the General Office of the State Council issued the “Opinions on Strengthening the Protection of Intellectual Property Rights.” The Opinion stresses that “strengthening the protection of intellectual property rights is the most important part of improving the property rights protection system, and it is also the biggest incentive to improve China's economic competitiveness.” In the information and knowledge society, science and technology have become the primary productive force, and intellectual property is gradually becoming one of the most important forms of wealth. As an important guarantee for scientific and technological innovation and the creation of knowledge and wealth, intellectual property has become a strategic resource and a core element of market competitiveness for high-quality economic development. China has ranked first in the number of patent applications in the world for many years, and has completed the initial accumulation of intellectual property assets. In this case, how to activate intellectual property assets and how to transform intellectual property assets into practical knowledge wealth through commercialized operations will become a difficult problem to be studied and urgently solved.
Finance is the core of modern economy. General Secretary Xi Jinping has repeatedly emphasized that finance is an important core competitiveness of the country. When the finance is dynamic, the economy is dynamic. When the finance is stable, the economy is stable. When the economy is thriving, the finance is thriving. When the economy is strong, then finance is also strong. Economy is the body and the finance is the bloodline. They are inseparable. The process of creating intellectual wealth is not only the process of commercialization of intellectual property rights, but also the process of the financial system serving the real economy. In essence, the integration of intellectual property and the financial system is the process of effective allocation of financial resources in the field of innovation, as well as the process of effectively realizing the value of innovative resources in the field of finance. Thus, in order to truly make intellectual property the biggest incentive to improve China’s economic competitiveness and make the financial system better serve the high-quality development of China’s economy, we need to constantly explore the best practices for connecting intellectual property with the financial system.
At present, China’s capital market is comprehensively deepening reforms around the goal of “building a standardized, transparent, open, dynamic, and resilient capital market.” The science and technology innovation board has been officially opened, and the overall reform plan has basically taken shape. The Decision of the Central Committee of the Communist Party of China on Adhering to and Improving the Socialist System with Chinese Characteristics, Promoting the Modernization of the National Governance System, and Governance Ability adopted by the Fourth Plenary Session of the Nineteenth Central Committee once again emphasized the need to “strengthen the construction of the basic system of the capital market and improve its adaptability. To build a modern financial system that is flexible, competitive and inclusive.” The integration of intellectual property and the capital market can maximize the operation of intellectual property and create the intellectual wealth of the greatest value. It can also better serve the real economy and promote the economy to high-quality development.
The Shenzhen Special Economic Zone is an important window for China's reform and opening up and the birthplace of China's capital market. After nearly 40 years of development, Shenzhen has become an international and innovative city full of charm, power, vitality and innovation. Innovation and entrepreneurship are the natural genes of this city, and intellectual property protection is an important advantage of this city. Shenzhen is also a highland for the accumulation of intellectual property resources in China, and is also a pioneer in the reform of intellectual property commercialization operations. Opinions of the Central Committee of the Communist Party of China and the State Council on Supporting Shenzhen to Build A Leading Socialist Demonstration Zone with Chinese Characteristics clearly requires Shenzhen to “explore intellectual property securitization and regulate the orderly construction of an intellectual property and scientific and technological achievements property rights trading center.”
One end of intellectual property rights is connected with technological innovation, and the other end is followed by a multi-level capital market. The integration of intellectual property and the capital market is the best annotation for innovation-driven development and an effective support for high-quality economic development. Therefore, the holding of this forum can not only provide suggestions for the construction of the Guangdong-Hong Kong-Macao Greater Bay Area and the pioneering demonstration zone of socialism with Chinese characteristics, but also provide useful discussions for the establishment of a diversified capital market based on the realization of intellectual property values in China.
Socialism with Chinese characteristics has entered a new era, and reform and opening up have also begun a new journey. Our vision of intellectual property and strategic design also need to continuously seek new methods and set up new strategies under the guidance of Xi Jinping’s thoughts on new era socialism with Chinese characteristics. In particular, it is necessary to change the concept of intellectual property resource integration and platform construction, raise the horizon, and use a systematic thinking and a global perspective to face practice and the future, gather the strengths of all parties, and integrate global head resources. To this end, the inauguration ceremony of the “China Intellectual Property Protection Alliance” was solemnly held at the forum. The establishment of the alliance aims to integrate high-end knowledge and talent resources in the field of intellectual property at home and abroad, and promote the deep integration of intellectual property, technological innovation and capital markets. The members of the alliance include listed companies at home and abroad, innovative enterprises, colleges and universities, scientific research institutions, industry associations and other social organizations. All these institutions jointly build an internationally influential IP capitalization service platform, IP protection service platform, IP information service platform, and IP exchange service platform to assist enterprises in solving the core problems faced by the Chinese market operation and global market layout and challenges to help enterprises obtain faster and better development through capitalization channels such as listing and financing, so as to establish an intellectual property operation and protection system that matches the long-term development of enterprises.
In addition, the forum also announced that the “50 IPers Forum in China” will be established. This forum aims to gather global and domestic IP experts, scholars, and research results that are cross-field, cross-disciplinary, and cross-border with a global mindset, to contribute to major issues such as comprehensively deepening reforms in the new era and China’s participation in global economic governance.
