The protection for privacy and personal information caused by the new media industry has become heated issues, as the Civil Code of the PRC makes special regulation on the protection for privacy and personal information.
The seminar on the issue of protection for privacy and personal information in the new media industry was held in Beijing Friendship Hotel on October 17, 2020 by Intellectual Property Academy of Renmin University of China and the Research Center of Civil and Commercial Jurisprudence of Renmin University of China with the support of SSIP, in order to improve the communication between regulatory authorities and judicial organ and help them understand better about the trend of the industry to perfect policies and regulations in the age of Internet with intellectual support. Representatives of enterprises, experts and scholars, legislative and judicial personnel and relevant administrative personnel were invited to participate in the seminar.
The seminar was divided into two parts with items of “The Limits for New Media Platforms to Obtain Users’ Information” and “The Protection of Privacy in Civil Code and the Development of New Media Industry”.
The first session on “The Limits for New Media Platforms to Obtain Users’ Information” was hosted by Prof. Guo He, the vice dean of Intellectual Property Academy of Renmin University of China. During this session, Qu Linggang, senior counsel of ByteDance corporation spoke at the conference on the topic of “The development of new media platforms and the protection of personal information in the era of big data” and Yangming, professor of Peking University Law School gave a lecture on “Private rights and social welfare for new media platforms to obtain users’ information”. Prof. Mei Xiaying of University of International Business and Economics gave a speech on “The protection and risk prevention of personal information on new media platforms” while Liu Xiaochun, the standing director of Internet Nomocracy Center of University of Chinese Academy of Social Sciences talked the topic about “The judicial protection of personal information on new media platforms”. Besides, Chen Changyi, the president of the People's Court of Haidian District, Beijing and Yan Jun, the judge of Beijing Internet Court respectively spoke at the conference with topics of “Logical justification and practical reflection on the legitimacy of personal information obtained by new media platforms” and “The limits of APP to obtain users’ information in typical cases”.
After the guests’ speech, Zhu Wei, the deputy director of Communication Law Research Center of China University of Political Science and Law and Zhang Chun, the president of Guangzhou Internet Court gave their comments.
The other session on “The Protection of Privacy in Civil Code and the Development of New Media Industry” was hold by Yao Huanqing, the secretary-general of SSIP and deputy director of the Research Center of Civil and Commercial Jurisprudence of Renmin University of China. In this session, Huang Zhuxin, the senior researcher of Sohu Law Research Institute talked about “The practice and reflection on personalization mechanisms of new media platforms under the regulation of privacy and personal information in the Civil Code”. Yao Jia, the researcher of Law Research Institute of Chinese Academy of Social Science shared her opinions on “Private information in the Civil Code and the limits on the use of new media”. Huang Juanmin, the president of Intellectual Property Division of People’s Court of Nanshan District of Shenzhen appointed judge’s assistant Su Heng to give a speech on “Judicial confirmation on personal information”. Zheng Ning, the director of Law Department of School of Cultural Industries Management in Communication University of China shifted his lens to “The influence of regulation of privacy and personal information in the Civil Code on the new media industry”. Prof. Guo Rui of Law School of Renmin University spoke at the conference on the topic of “The Limits for new media platforms to obtain users’ information” while Shi Jiayou, the standing director of the Research Center of Civil and Commercial Jurisprudence of Renmin University of China talked about “The protection of privacy and the regulation of We Media”. In the end of this session, Ding Xiaodong, the vice dean of Law and Technology Institute of Renmin University of China and Liu Chuntian, the dean of School of Intellectual Property of Renmin University of China and president of the Intellectual Property Law Association of the China Law Society made comments on the guests’ speech.
The media including China Court Press, Zhichanli Platform, Caixin Weekly and China Market Regulation News participated in this seminar.
