Recently, Beijing Sunshine Intellectual Property and Legal Development Foundation received the certificate of completion of the soft scientific research project of the National Intellectual Property Administration. The soft project "Research on the Extraterritorial Application of the Basic Law of Intellectual Property" undertaken by the Foundation was reviewed and concluded by the National Intellectual Property Administration.

In order to improve the foreign jurisdiction system for intellectual property disputes, provide legal protection for China's scientific and technological security, and provide strategic support for China's participation in global scientific and technological competition; actively participate in the construction of the international intellectual property order, and promote the establishment of a new model of intellectual property protection in the world; improve the intellectual property protection procedural law system to promote the improvement of China's foreign civil litigation system, the National Intellectual Property Administration entrusted the Beijing Sunshine Intellectual Property and Legal Development Foundation research group to carry out the research work on "Judicial Protection and Extraterritorial Application of the Basic Law of Intellectual Property", and the project was established as a key project of Class A.

This project is led by senior experts Chuntian Liu and Professor Kesheng Jin from the Foundation, a research team of experts from the Law Institute of the Supreme Court, relevant universities, law firms and other well-known industry researchers to carry out the research together. In the form of questionnaires, seminars, expert consultations, etc., the team carried out the work using the methods such as empirical research, comparative research and expert discussion. In particular, it comparatively studies the relevant laws and regulations of the United Kingdom, the United States, France, Germany and other countries, as well as relevant extraterritorial intellectual property litigation cases involving Chinese enterprises. By sorting out the basic situation and problems of intellectual property legal protection at domestic and foreign, combined with the cases of intellectual property litigation of Chinese and foreign enterprises, as well as China's intellectual property strategy practice and the actual needs of participating in international governance, it fully demonstrates the reality and its historical significance of research on the extraterritorial application of the basic intellectual property law. As well as the necessity and feasibility of establishing an extraterritorial intellectual property jurisdiction system and an extraterritorial litigation preservation system in China, it puts forward suggestions for establishing an extraterritorial intellectual property jurisdiction and an extraterritorial litigation preservation system also gives the specific legal suggestions.

The project report has both the height of national strategy and international governance, and the depth of theory and practice, which provides theoretical support and practical reference for the extraterritorial application for China's basic law of intellectual property.
