IP Café Seminar on Trademark Squatting

On the afternoon of January 25, 2022, the IP Café seminar on trademark squatting was successfully held at the Kempinski Hotel Beijing through a combination of online and offline forms. The guests discussed the issues such as the determination of trademark squatting, relevant laws and regulations, and the burden of proof to prove malicious intent. The conference was co-organized by IPKEY China and Beijing Sunshine Intellectual Property and Legal Development Foundation. The EU delegation to China supported the convening of the meeting.

Professor Chuntian Liu, Dean of the college of intellectual property, Renmin University, Huanqing Yao, secretary general of Beijing Sunshine Intellectual Property and Legal Development Foundation, Yan Hong, development assistant to the Dean of Tsinghua University Law School, and Xiaojuan Zhang, a lawyer from Beijing Longan Law Firm, delivered keynote speeches at the meeting.

In the opening speech, Professor Chuntian Liu reviewed the modernization process of China's trademark legal system and clarified the issues such as the boundary between public rights and private rights involved in trademark squatting.

In the first half of the discussion session, Benoit Misonne, Intellectual Property Commissioner of the EU delegation to China, secretary general Huanqing Yao, lawyer Xiaojuan Zhang, and Paul Ranjard, legal counsel of the French Manufacturers Federation, discussed the causes of trademark squatting, the definition of trademark squatting, and the connotation and types of squatting behavior, the new trend of judicial practice and other issues were discussed in depth.

In the second half of the discussion session, secretary general Huanqing Yao, partners of Hengfang Law Firm, Mr. Reinout van Malenstein, Ms. Yan Hong, and Mr. Stephan Hanne, legal affairs expert of the European Union Intellectual Property Office, discussed the differences between the EU and China’s trademark systems, and the court’s decision to trademark squatting. Changes in behavioral stances, sanction ideas, allocation of burden of proof, and best practices in China and Europe shared the experiences and opinions.
